Terms of Service

These Terms of Service ("Terms") govern your use of Katama, operated by Chainvision Games FZCO ("we", "us", "Katama"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Service Description

Katama is an AI creation platform that aggregates third-party AI models (image, video, chat, audio, multi-step workflows) behind a single subscription. We act as a technical service provider; the underlying models are operated by third parties listed in our Privacy Policy.

2. Eligibility

You must be 18 years of age or older.
You must provide accurate registration information.
One person, one account. Sharing or transferring accounts is prohibited.

3. Subscriptions, Credits & Billing

3.1 Plans

We offer monthly subscription plans (Rōnin, Shinobi, Samurai, Daimyō, Shōgun) and one-time credit packs. Current pricing is at katama.ai#pricing. Prices are subject to change with 30 days notice.

3.2 Auto-Renewal

Subscriptions auto-renew at the end of each billing cycle unless cancelled. You can cancel at any time in your Billing settings; cancellation takes effect at the end of the current cycle.

3.3 Credits

Each plan includes a monthly credit allotment that resets at the start of each billing cycle. Unused credits do not carry over to the next cycle. Credits have no cash value, cannot be transferred to other accounts (except via the optional Diamond-tier gift feature), and are forfeited if your account is terminated for cause.

3.4 Refunds

EU consumers have a 14-day right of withdrawal for subscriptions unless they have already used the service (consumed credits). Once you generate anything, you waive the right of withdrawal for the consumed portion. For other refund situations, contact billing@katama.ai.

3.5 Payment Methods

Credit/debit card via Stripe
Cryptocurrency via NOWPayments (BTC, ETH, SOL, USDC, etc.)
$KATA token directly (earns bonus credits)

Payments are charged in EUR. Crypto amounts are calculated at the market rate at the time of checkout, locked for 30 minutes.

3.6 Smart Memory (optional, per project)

Projects can enable Smart Memory. After each image or video you generate inside a project, Katama uses a low-cost AI model to maintain a short running “memory” of that project — recurring characters, visual style, tone, and what you keep asking for — and applies it to later generations in the same project so your results stay consistent instead of starting from scratch each time. Each memory update costs 1 credit, charged only when the update actually succeeds. Smart Memory is on by default and can be switched off — or its stored memory wiped — at any time in a project's settings; while it is off, no memory is read or written and no memory credit is charged. The memory is derived solely from your own Inputs in that project, stored under your account, and deleted when the project or your account is deleted.

4. $KATA Token (Important)

Katama offers an optional integration with the $KATA token (an existing cryptocurrency operated by Katana Inu / Chainvision Games):

Paying with $KATA grants bonus credits that scale with how much $KATA you hold (1% from $100 · 2% from $250 · 3% from $500 · 5% from $1k · 6% from $5k · 10% from $10k), after a 7-day holding period — on subscriptions and credit purchases. Holdings below $100 earn no bonus.
Holding $KATA in your linked wallet grants bonus credits on your monthly grant, scaling with your holding on the same ladder (7-day hold). The bonus requires an active paid subscription.
Affiliate commission. Referrers earn a percentage of the net revenue (gross minus payment/processing fees) their referred users pay, for up to 36 months per referral. Rates are based on the referrer's verified $KATA holding and differ by channel: subscriptions — 15% (no $KATA), 20% (from $1,000 held), 25% (≥ $10,000 held) in year 1, reduced to 5 / 10 / 15% in years 2–3; credit purchases — a $KATA-holder-exclusive channel: 0% for non-holders, 5% for holders, 7% at ≥ $10,000 held. Rates are live — selling $KATA drops you to the base rate immediately. Commission is never paid on a referrer's own purchases, and is subject to change with notice.
Referral rewards & promotions. From time to time we may offer referral rewards — for example, a $KATA token reward for both the referrer and a referred user who completes a qualifying paid plan. All such rewards are promotional and time-limited: eligibility, reward amounts, qualifying conditions, and availability may be introduced, changed, reduced, paused, or discontinued at any time at our sole discretion, with or without prior notice. Rewards are not a guaranteed benefit of the service, have no cash value payable by Katama, and may require on-chain claiming within a stated window; unclaimed, expired, or ineligible rewards may be forfeited. Any abuse — including fake accounts, self-referrals, or circumventing the qualifying-payment requirement — voids all related rewards and may result in account suspension.

$KATA is a utility token, not a security or investment instrument. Its purchase, sale, and price are entirely separate from Katama and are not part of the service we provide. We do not give financial advice. The bonus mechanics are subject to change with notice; tier thresholds are denominated in USD and recalculated daily based on live token price.

5. Acceptable Use

You may NOT use Katama to generate, distribute, or facilitate:

Illegal content under EU or UAE law
Sexual content involving minors, or content sexualizing real identifiable persons without consent
Deepfakes of identifiable persons intended to deceive or harass
Content that violates the AUP of underlying AI providers (FAL, OpenAI, Anthropic, ElevenLabs, Google)
Malware, phishing kits, or other tools designed to harm others
Spam or unsolicited bulk communications
Content that infringes third-party intellectual property
Hate speech, incitement to violence, terrorist content
Attempts to reverse-engineer, scrape, or proxy the service
Automated abuse of credits, rate limits, or bonus mechanics

Fictional violence & gore are allowed. Cinematic or stylized violence for storytelling — action and fight scenes, horror, blood, a knocked-out tooth, a severed limb in a film — is fine. What is never allowed is content that targets a real, identifiable person: you may not depict a real person being harmed, in sexual content, or in any degrading way unless that person is you or has given you their explicit consent. Sexual content involving minors (CSAM) and any other illegal content are always prohibited, regardless of art style or stated intent. We do not manually pre-screen every generation, but we reserve the right to review and remove content, suspend accounts, and — where the law requires it — report illegal material to the authorities and cooperate with any resulting prosecution.

You confirm your use is lawful and for entertainment. Because we do not pre-screen generations, you — not Katama — are responsible for what you create. By generating content you confirm and warrant that it is for lawful, fictional or entertainment purposes, that any violence depicted is fictional, and that you do not depict a real, identifiable person without their consent. The underlying AI providers (such as Seedance and the other models) apply their own safety filters, but final responsibility for lawful use remains yours.

We may suspend or terminate accounts that violate these rules without refund. We cooperate with law enforcement when legally required.

6. Intellectual Property

6.1 Your Content (Inputs)

You retain ownership of the prompts, images, audio, and other materials you submit ("Inputs"). By submitting Inputs, you grant us a limited license to process them through the AI providers for the sole purpose of generating Outputs and operating the service.

6.2 Generated Content (Outputs)

Subject to the terms of the underlying AI providers, you own the Outputs generated for you. You may use them commercially. Note that:

AI-generated content may not be copyrightable in all jurisdictions (e.g., US Copyright Office position). Consult counsel for commercial use cases.
Some models (e.g., certain image models) may produce content that inadvertently resembles trademarked or copyrighted works. You are responsible for clearing such uses.
The underlying providers (FAL.ai, OpenAI, Anthropic, Google, ElevenLabs) have their own usage policies you must comply with.

6.3 Our Platform

The Katama platform, software, design, brand, and documentation are owned by Chainvision Games FZCO and protected by intellectual property law. You receive only a limited right to access and use the service according to these Terms.

7. Disclaimers

Katama is provided "as is" without warranty of any kind. We do not guarantee that AI outputs will be accurate, suitable for your purpose, free of bias, or non-infringing. AI models are probabilistic and may produce unexpected results.

We are not responsible for content generated by users. We are not responsible for downtime of third-party AI providers. We will use commercially reasonable efforts to maintain service availability but do not guarantee uptime.

8. Limitation of Liability

To the maximum extent permitted by law, our total liability arising from or related to your use of Katama is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business opportunities.

This limitation does not apply to: (a) liability that cannot be limited under applicable law (e.g., gross negligence, willful misconduct), (b) damages caused by our breach of essential contractual obligations.

9. Indemnification

You agree to indemnify and hold Katama harmless from claims arising from: (a) your violation of these Terms, (b) your violation of any third-party rights, (c) Outputs you generate that violate law or third party rights.

10. Termination

You may delete your account at any time from your settings.
We may suspend or terminate accounts for violations of these Terms, inactivity over 24 months, or business reasons (with reasonable notice).
On termination, unused credits expire. Subscription refunds, if any, are pro-rated for the unused portion.

11. Changes to These Terms

We may update these Terms. We will notify you of material changes by email or in-app notice at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.

12. Governing Law & Disputes

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-laws principles. EU consumers retain the protection of mandatory provisions of their home jurisdiction.

For disputes, please first contact business@katanainu.com to attempt good-faith resolution. EU consumers may also use the EU online dispute resolution platform at ec.europa.eu/consumers/odr/.

13. Miscellaneous

Entire agreement. These Terms and our Privacy Policy are the entire agreement between us.
Severability. If any provision is found unenforceable, the rest remains in effect.
No assignment. You may not assign these Terms; we may assign in connection with a merger, acquisition, or sale of assets.
No waiver. Our failure to enforce any provision is not a waiver of that provision.
